These Terms and Conditions constitute a legally binding agreement between you and Coin Logic. By accessing our website or engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

This agreement governs your use of our arcade game development services, website, and all related communications and interactions. If you do not agree with any provision of these terms, you must immediately discontinue use of our services.

These Terms and Conditions supplement, and do not replace, our Terms of Service and Privacy Policy, which should be read in conjunction with this document.

You agree to indemnify, defend, and hold harmless Coin Logic, its directors, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  3. 6.3 Your violation of any applicable laws or regulations
  4. 6.4 Content or materials you provide that infringe on intellectual property rights

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  1. 9.1 Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  2. 9.2 Warranties regarding the accuracy, reliability, or completeness of content
  3. 9.3 Warranties that services will be uninterrupted, timely, secure, or error-free
  4. 9.4 Warranties regarding results that may be obtained from using our services

Article 10: Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COIN LOGIC, ITS DIRECTORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR:

  1. 10.1 Any indirect, incidental, special, consequential, or punitive damages
  2. 10.2 Loss of profits, revenue, data, use, goodwill, or other intangible losses
  3. 10.3 Damages resulting from unauthorized access to or alteration of your data
  4. 10.4 Damages resulting from any third-party services or products

Our total liability for all claims arising from or related to these Terms and Conditions or our services shall not exceed the amount paid by you to Coin Logic in the twelve (12) months preceding the claim.

Article 11: Consequential Damages Exclusion

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. The limitations and exclusions in this section apply regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise.

Article 12: Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions due to circumstances beyond our reasonable control, including but not limited to:

  • ▸ War, terrorism, civil unrest, or government action
  • ▸ Internet or telecommunications failures
  • ▸ Labor disputes, strikes, or lockouts

Legal Provisions and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where Coin Logic is registered, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms and Conditions or our services shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by mandatory consumer protection laws.
